Dr. jur. Michael Jaffé wurde als Insolvenzverwalter über das Vermögen von Qimonda eingesetzt. Die Inhalte der Internetseite können NICHT als rechtlich bindendes Verkaufsangebot interpretiert werden, jeglicher Inhalt ist lediglich aus Informations- und Geschäftsanbahnungsgründen angegeben.

Für fahrlässiges Verhalten haftet Qimonda nicht, es sei denn, dass wesentliche Vertragspflichten durch Qimonda, seine Erfüllungsgehilfen und/oder gesetzlichen Vertreter verletzt werden.
6.2 Im Falle der Haftung für Fahrlässigkeit nach Ziffer 6.1 Satz 2 ist eine Haftung von Qimonda und/oder seinen Erfüllungsgehilfen und gesetzlichen Vertretern für Vermögensschäden, mittelbare Schäden, insbesondere Mangelfolgeschäden, unvorhersehbare Schäden, untypische Schäden sowie entgangenen Gewinn ausgeschlossen.
6.3 Eine gesetzlich vorgeschriebene verschuldensunabhängige Haftung von Qimonda - insbesondere eine gesetzliche Garantiehaftung - bleibt von den vorstehenden Haftungsbeschränkungen unberührt. Gleiches gilt für die Haftung von Qimonda bei schuldhafter Verletzung von Leben, Körper oder Gesundheit.
6.4 Dr. jur. Michael Jaffé als Insolvenzverwalter gibt keine persönliche Garantie und übernimmt keine Haftung für etwaige Verpflichtungen aus diesen Nutzungsbedingungen. Jegliche persönliche Haftung des Insolvenzverwalters im Zusammenhang mit den Nutzungsbedingungen wird - soweit gesetzlich zulässig - ausgeschlossen. Dies gilt insbesondere für Verpflichtungen nach §§ 60, 61 der Insolvenzordnung und/oder nach § 311 (2) BGB aber auch für Verpflichtungen auf anderer Rechtsbasis. Falls eine persönliche Haftung anderweitig gegeben ist, können die Beteiligten nur für absichtliches Fehlverhalten und grobe Fahrlässigkeit haftbar gemacht werden.
6.5 Die Ziffern 6.1 bis 6.3 umfassen sämtliche vertraglichen und nicht vertraglichen Ansprüche, die aus der Nutzung der Internetseite von Qimonda resultieren.

6.2 In case that Qimonda is liable for ordinary negligence according to Section 6.1, such liability of Qimonda, its vicarious agents and/or legal representatives does not include pecuniary, indirect, incidental, unforeseeable or untypical damages as well as loss of profit.
6.3 Statutory no-fault liability of Qimonda - in particular liability under a statutory guarantee - remains unaffected. This also applies to the liability of Qimonda resulting from wrongful harm to life, body or health.
6.4 Dr. jur. Michael Jaffé as insolvency administrator – provides no personal guarantee and assumes no personal liability for the obligations – if any - arising from these Internet terms of use. All personal liability on the part of the insolvency administrator arising out of or in connection with Internet Terms of Use is excluded to the extent permissible by statute. This applies in particular to obligations pursuant to §§ 60, 61 of the German Insolvency Act (Insolvenzordnung) and/or § 311 (2) BGB, but also to obligations arising under any other legal basis. In the event that personal liability on the part of the insolvency administrator should otherwise exist, this party shall only be liable for intentional misconduct and gross negligence.
6.5 Sections 6.1 through 6.3 apply to all contractual and non-contractual claims that might result from the use of the Website.
